6 Steps to Opening an Estate for Probate in Alabama

Depending on your estate, the need to Probate after death may be avoided. However, if one's assets and/or circumstances require the Probate of their Will, below are 6 steps that summarize how to Open an Estate for Probate in Alabama.

1. Attorney examines the type of Probate proceeding to open and proper Probate Court in which to file the estate.
2. Attorney files a Petition with the Probate Court requesting formal appointment of the Personal Representative/s (PR) and Letters Testamentary.
3. Attorney notifies spouse and/or next of kin of the opened Estate
4. Attorney requests a bond for the PR, if needed
5. Attorney, at times, may have to attend a Hearing with the Probate Court
6. If everything is presented properly, the Probate Judge issues an order to open the Estate and grant Letters Testamentary

After the attorney has started the probate process with these 6 steps and obtained Letters Testamentary, administering the estate can begin.
